The 341 Meeting
Upon filing, I will give you further information about attending the 341 Meeting. About a month after I file your petition, the trustee will conduct a meeting of creditors. During this meeting, the trustee puts you under oath, and both the trustee and your creditors creditors may ask questions. You must attend the meeting and answer questions regarding the debtor’s financial affairs and property. If a husband and wife have filed a joint petition, they both must attend the creditors’ meeting and answer questions. Within 10 days of the creditors’ meeting, the U.S. trustee will report to the court whether the case should be presumed to be an abuse under the means test.
Cooperating with the Trustee
It is important for the debtor to cooperate with the trustee and to provide any financial records or documents that the trustee requests. The Bankruptcy Code requires the trustee to ask the debtor questions to ensure that the debtor is aware of the potential consequences of seeking a discharge in bankruptcy such as the effect on credit history, the ability to file a petition under a different chapter, the effect of receiving a discharge, and the effect of reaffirming a debt. Some trustees provide written information on these topics at or before the meeting to ensure that the debtor is aware of this information.
I will attend the 341 Meeting with you. Together, we will meet with the trustee, and discuss the pending discharge. The trustee may ask you questions about the Petition. Because of this, you will want to thoroughly review the petition before you sign it, and again before the 341 Meeting to refresh your memory. If you notice any corrections that need to be made, you will want to advise me of those changes as soon as possible.
Documents You Must Provide to Trustee
Prior to your 341 Meeting, we will neem to provide the following to the Trustee.
1. Proof of income for last 60 days prior to filing.
2. Last filed tax return.
3. Most recent paystub after filing. (Including income from all sources, Pensions, Social Security and Unemployment)
4. A statement of all your bank accounts, investment accounts, mutual funds and brokerage accounts that shows your account balance on the date of filing.
Required Documents To Bring With You
You are required to bring to your 341 Creditor’s Meeting the original or certified copy of your proof of identity and verification of your entire Social Security number.
